Classification: Essential: This position is an Essential classification and will require the employee to report for duty before, during and/or after an emergency or hurricane.
Schedule: This position normally works a regular weekday daytime shift and requires immediate response to emergency conditions.
Supervision Exercised: Risk Safety Specialist
Supervision Received: Works under the direction of and is responsible to the City Administrator, Chief Operating Officer, Director of Administrative Services, or designee. General assignments may be directed from City Administration with some degree of latitude for use of independent judgment in work methods and procedures.
General Purpose of the Position: Under the direction of City Administration, performs highly responsible, technical, and administrative work utilizing extensive knowledge and skills obtained through education and experience to progress with the direction of assigned risk discipline(s), with specific focus on the design, development, implementation, and ongoing improvement of the Risk Safety & Liability program. Is responsible for identification and elimination or mitigation of hazardous conditions and investigation of injuries and accidents arising from City operations. Under limited direction, collaborates effectively with multiple stakeholders, including extensive contact with executive management. May be required to lead others in identifying, researching, analyzing, and resolving complex issues. Oversees the overall administration, development and direction of the risk management functions including oversight of self-insurance, commercial insurance, loss control, workers compensation, property and casualty claims, and training and safety management.
Essential Duties and Responsibilities:
- Develops and implements programs designed to reduce the City's risk exposure. Coordinates and works with all departments to enhance City-wide awareness of risk management and safety related issues.
- Supervises claims processing and adjudication of all City claims, including workers' compensation, general liability, and auto liability. Manages the City's property and casualty insurance programs, contractual risk in City relationships with outside vendors and contractors.
- May be tasked with collaborating with City Administration, Building Official and Planning and Community Development on disaster mitigation and recovery.
- Provides continuous evaluation of existing insurance coverage in relation to changing insurance market conditions and fluctuating risk factors and recommends revisions, additions and/or deletions in the City’s property and casualty insurance programs.
- Represent the City as needed in contract negotiations with third party administrators (TPA’s) and insurance companies. Reviews and makes recommendations on proposed contract provisions in support of insurance proposals and agreements.
- Reviews and recommends to City Administration all excess insurance coverage for City owned property and exposures to liability for all types of claims.
- Identifies risks and exposure for losses to City assets; develops strategic risk management plans, goals, and objectives.
- Identifies and selects business processes, major products, and services, including property, casualty, automobile, and worker's compensation programs and make recommendations for programs and coverage to City Administration.
- Oversees the claims processes; directs and supervises all phases of the claims process from intake and investigation through litigation, settlement and/or trial; consults with City Administration and provides guidance and/or participates in negotiations, conferences and mediations with adjusting companies, legal counsel, City staff, claimants, etc.
- Develops contractual insurance and indemnification requirements for City projects; provides consultative advice to divisions regarding risks associated with various contractual activities; and reviews final agreements for compliance with risk management standards/practices.
- Oversees administration of City-wide training programs to minimize losses resulting from accidents, natural causes, regulatory non-compliance, and legal insurance claims against the City; oversees database for related training needs.
- Serves as custodian of insurance records and presents testimony in that capacity as needed to ensure proper procedures in the investigation, analysis and settlement of claims made against the City.
- Direct and manages programs and funds, functions and activities relating to safety, loss prevention, property and casualty insurance, workers compensation, and related Risk Safety & Liability Management activities.
- Presents thorough and accurate reports on claims investigations/situations for presentation to City Administration and related Risk Counsel and third-party administrators.
- Provides accurate information and detail concerning work progress, including present and potential work problems and suggestions for improved ways of addressing such problems and recommends practical solutions to eliminate hazardous conditions.
- Advises and informs City Administration regarding issues and concerns relating to Risk Safety & Liability Management; provides statistical reports as required.
- Counsels and advises department heads and other City officials, supervisors, and employees on the application and interpretation of the City’s policies, ordinances and state statutes regarding any types of claims, workers’ compensation, safety and insurance issues.
- Meet and confer with representatives of various City departments concerning claims against the City and safety matters.
- Responds to inquiries regarding safety or Risk Safety & Liability issues, in a timely manner.
- Analyzes, develops, and monitors Risk Safety & Liability policies and procedures for city-wide implementation.
- Serves as the City’s Safety liaison and a resource for the public, building and maintaining effective relationships with the business community, advisory boards, community organizations and citizens.
- Attend Safety &Risk Safety & Liability workshops, seminars, classes and meetings when beneficial to the City.
- Coordinate the City Safety Training programs, monthly, quarterly and yearly when necessary.
- Analyzes on an ongoing basis the excess insurance coverage needs for the various categories of risk the City is exposed to and makes professional recommendations on the periodic adjustments of such excess coverage.
- Develops strategies and negotiates claims to a timely conclusion, properly applying City and department policies and procedures. Decides on conclusion of loss based upon analysis of the facts, liability and statutory/case law.
Skills and Physical Abilities Required:
- Must possess strong program management and interpersonal skills and makes sound decisions, exhibiting initiative and intuitive thinking.
- Knowledge, skill, and ability to conduct complete investigations of claims through any appropriate techniques including interviews, documented statements, documentation/data gathering and securing/preserving evidence.
- Knowledge of Risk, loss control, safety programs and, policies including fleet and liability insurance and workers’ compensation.
- Ability to analyze and exercise judgment and discretion in applying and interpreting departmental functions, procedures and policies.
- Ability to establish and maintain effective working relationships with co-workers, elected officials, community interest groups and the public.
- Knowledge of federal, state, and local laws, City ordinances, and other applicable regulations, standards and requirements, as well as court and regulatory body decisions governing or related to the fields of Risk insurance.
- Knowledge of budgeting and fiscal procedures and methods.
- Ability to develop complex multi-program budgets and monitor budget expenditures.
- Ability to plan, design and implement an effective City-wide safety program.
- Ability to communicate effectively, both orally and in writing, including public speaking and preparing written reports, memoranda, and graphic presentations.
- Ability to identify problems and to initiate solutions and/or corrective measures.
- Performs other related duties as assigned.
Computer Equipment and Software Requirements: Proficiency in computer software and the ability to adapt to other software programs with ease including Microsoft Office products. Basic knowledge of MUNIS ERP systems and/or asset management module software is preferred.
Education and Experience Required: Graduation from an accredited college or university with a Bachelor’s degree in Public Administration, Business, or related field, plus a minimum of five (5) years of progressively responsible professional experience in Risk, liability, claims adjusting, and/or safety administration is required, preferably in the public sector.
Preferred: Claims Adjuster license preferred. Associate of Risk Management (ARM), ARM-P (Public Entity), and/or Chartered Property/Casualty Underwriter (CPCU) designation, desired. Florida experience, preferred.
At the discretion of the City Administrator or designee, an equivalent combination of education and experience sufficient to provide the employee with the knowledge, skills, and ability to successfully perform the essential functions of the job will be considered.
Valid Florida Driver License is required or ability to obtain within 30 days of establishing residency in Florida and ability to maintain a valid Florida driver’s license.
Environmental Conditions: Mostly indoors in an office environment. May be outdoors occasionally for accident investigations or safety issues.
